Coimbatore: In a significant legal victory for Champion Textiles Ltd., an arbitral tribunal has mandated JMJ Housing Ltd. and its director to pay a compensation of Rs. 7.75 crore. This ruling, issued on October 12, 2026, pertains to a contentious agreement tied to a residential development project in Coimbatore.
Justice T. Ravindran, a former Judge of the Madras High Court, served as the sole arbitrator in Arb. O.P. (Com. Div.) No. 394 of 2024, providing the judgment that undertakes to address grievances surrounding a Joint Development Agreement (JDA) executed on January 19, 2022.
The conflict arose from property located in Pattanam village of Coimbatore district, where Champion Textiles, represented by Managing Director V.R.S. Natarajan, entered the agreement with JMJ Housing, whose director is Wilson P. Thomas. This arrangement was tailored to define responsibilities for developing residential units and splitting the resultant benefits.
However, disagreements surfaced over contractual obligations and the management of plots within the developmental sphere. Champion Textiles contended that numerous plots were transferred unlawfully to third parties, breaching the contract and the General Power of Attorney associated with it.
Countering these claims, JMJ Housing asserted they had significantly invested time and resources into the project, working diligently on developmental tasks as outlined in the original agreement.
Following a thorough review of documents, witness accounts, and various pleadings, Justice Ravindran ruled in favor of Champion Textiles, outlining critical breaches occurring on part of the developer. The findings specifically addressed the inadequate compliance with development obligations and unauthorized property transfers.
Consequently, the tribunal reached firm conclusions regarding the disputed transactions, declaring them inconsistent with the contractual framework, and ordered the nullification of the related sale deeds.
The compensation awarded included two distinct amounts: Rs. 6.75 crore to be paid with 18% annual interest starting from March 13, 2025. Additionally, the tribunal stipulated another payment of Rs. 1 crore, which also accrues interest at 18% per annum from the date of the award until fully settled. This brings the total more than just monetary compensation to Rs. 7.75 crore, excluding interest and further arbitration costs.
Alongside the financial recompense, the tribunal directed the cancellation of 10 specific sale deeds concerning the disputed land. Furthermore, the arbitrator ordered JMJ Housing and its directors to vacate the premises as delineated in Schedule A of the ruling and return possession to Champion Textiles within one month of the judgment.
This ruling follows an intricate arbitration process where both parties presented dueling claims pertaining to their respective contractual responsibilities, undertaken development efforts, and the legitimacy of third-party transactions.
The award is dated October 12, 2026, marking a notable decision in the realm of property disputes, while the future legal standing and execution of its orders remain separate considerations beyond the arbitration’s findings.
